{"id":17260,"date":"2025-09-10T10:39:54","date_gmt":"2025-09-10T10:39:54","guid":{"rendered":"https:\/\/sceptical.scot\/staging\/?p=17260"},"modified":"2025-10-07T13:44:22","modified_gmt":"2025-10-07T13:44:22","slug":"ferreting-out-radioactive-leaks-from-trident","status":"publish","type":"post","link":"https:\/\/sceptical.scot\/staging\/2025\/09\/ferreting-out-radioactive-leaks-from-trident\/","title":{"rendered":"Ferreting out radioactive leaks from Trident"},"content":{"rendered":"\n<p><strong>Last month, Scotland\u2019s crowd-funded investigative journalism outfit <\/strong><em><strong>The Ferret<\/strong><\/em>, <strong>in partnership with <em>The Guardian<\/em>, <a href=\"https:\/\/theferret.scot\/radioactive-waste-pollution-nuclear-plant\/\" rel=\"\">published documents <\/a>showing that radioactive water from the Royal Navy\u2019s Coulport armaments depot leaked into Loch Long after ageing pipes burst and flooded areas where nuclear warheads are handled.<\/strong><\/p>\n<p>Loch Long is a 20-mile-long seawater loch that flows into the Firth of Clyde. People fish there; they swim and paddleboard. They had a right to know about the leak &#8211; and we all had a right to know about sloppy work practices at the base, which is essentially a floating dock for the UK\u2019s Trident submarine fleet.<\/p>\n<p>I bumped into Edwards &#8211; whom I know because we are both members of the Edinburgh NUJ freelance branch &#8211; during the Edinburgh Book Festival and asked him about this; \u00a0he explained it had taken him six years to get the evidence released.<\/p>\n<blockquote>\n<p>Edwards said the incident should have been disclosed in 2019 &#8211; instead, years of withholding and delay turned it into a major public\u2011interest story. Edwards was also &#8211; understandably &#8211; cross that some of the bigger media outfits that picked it up <strong>didn\u2019t even mention the Ferret.<\/strong><\/p>\n<\/blockquote>\n<p>Here is the story of the patient work behind this important scoop:<\/p>\n<div><hr \/><\/div>\n<h2 class=\"header-anchor-post\">The scoop<\/h2>\n<p>Files released by the Scottish Environment Protection Agency (SEPA) cite \u201c<strong>shortfalls in maintenance<\/strong>\u201d across roughly <strong>1,500<\/strong> ageing pipes and refer to the production of \u201c<strong>unnecessary radioactive waste<\/strong>\u201d reaching the loch via an open drain.<\/p>\n<p>The <strong>MoD<\/strong> maintains there were <strong>no unsafe releases<\/strong>; <strong>SEPA<\/strong> says measured levels were <strong>very low<\/strong> and points to subsequent improvements.<\/p>\n<blockquote>\n<p><strong>Edwards\u2019s view is: \u201cThis should not have happened. However low the levels, radioactive tritium doesn\u2019t belong in the loch.\u201d<\/strong><\/p>\n<\/blockquote>\n<div><hr \/><\/div>\n<h2 class=\"header-anchor-post\">Why Edwards went fishing<\/h2>\n<p>Edwards has worked this beat for decades. In <strong>2008\u201309<\/strong>, assisted by campaigners, his FOI requests to SEPA unearthed documents about previously undisclosed submarine coolant leaks at Faslane \u2014 coverage that led new bulletins and <a href=\"https:\/\/www.theguardian.com\/environment\/2009\/apr\/27\/nuclear-mod-clyde-saftey-breaches\" rel=\"\">front pages.<\/a> That experience, he says, \u201cestablished a pattern: the MoD is not as transparent as it should be on environmental issues\u201d, and SEPA can be a productive route for disclosure under FOI\/EIR.<\/p>\n<p>In <strong>2019<\/strong>, Edwards sought fresh records of radioactive incidents at Faslane\/Coulport. Much was withheld on national\u2011security grounds.<\/p>\n<p>Then SEPA suffered a catastrophic <strong>cyber\u2011attack<\/strong>; amid the pandemic, his request \u2014 along with nearly 1,000 others \u2014 was <a href=\"https:\/\/theferret.scot\/sepa-quietly-scrapped-1000-information-requests\/\" rel=\"\">quietly <\/a><strong><a href=\"https:\/\/theferret.scot\/sepa-quietly-scrapped-1000-information-requests\/\" rel=\"\">abandoned<\/a><\/strong> without notice. Edwards re\u2011filed his requests for full coverage before and added on for after 2019. Again, much was withheld, and he appealed.<\/p>\n<h2 class=\"header-anchor-post\">Scotland\u2019s Information Commissioner ruled this should be released<\/h2>\n<div class=\"pencraft pc-display-flex pc-alignItems-center pc-position-absolute pc-reset header-anchor-parent\">\n<div class=\"pencraft pc-display-contents pc-reset pubTheme-yiXxQA\">Because the material concerned the environment, Edwards\u2019 case fell under <strong>Environmental Information Regulations (EIRs)<\/strong>. Here, Scottish law set the terms \u2014 and the threshold for secrecy \u2014 that proved decisive.<\/div>\n<\/div>\n<ul>\n<li>\n<p>Under <strong>Scottish EIRs<\/strong>, information can be withheld for security only if disclosure would <strong>\u201cprejudice substantially\u201d <\/strong>national security.<\/p>\n<\/li>\n<li>\n<p>Under the <strong>UK\u2011wide<\/strong> regime, the bar is lower: disclosure that would merely \u201c<strong>adversely affect\u201d<\/strong> national security can be withheld.<\/p>\n<\/li>\n<\/ul>\n<p>Edwards appealed to <strong>Scotland\u2019s Information Commissioner (SIC)<\/strong>, <strong>David Hamilton<\/strong>, who can examine withheld material <strong>in camera<\/strong> and weigh the public interest. After investigating, Hamilton ordered SEPA to release <strong>nearly all<\/strong> of the documents. A last\u2011minute MoD intervention delayed release by about a week, but the ruling stood: publication <strong>would not threaten national security<\/strong> \u2014 though it might <a href=\"https:\/\/theferret.scot\/faslane-radioactive-secrets-revealed\/\" rel=\"\">threaten <\/a><strong><a href=\"https:\/\/theferret.scot\/faslane-radioactive-secrets-revealed\/\" rel=\"\">reputations<\/a><\/strong><a href=\"https:\/\/theferret.scot\/faslane-radioactive-secrets-revealed\/\" rel=\"\">.<\/a><\/p>\n<blockquote>\n<p><strong>Edwards argues that, had the appeal been to the UK ICO against the MoD directly, \u201cwe probably wouldn\u2019t be reading these documents now.\u201d <\/strong><\/p>\n<\/blockquote>\n<p>For UK\u2011wide bodies, he notes, requests and appeals run under the English test, which makes it easier for them to refuse release.<\/p>\n<div><hr \/><\/div>\n<h2 class=\"header-anchor-post\">Behind the scenes: MoD pressure on SEPA<\/h2>\n<p>To understand the withholdings, Edwards filed a <strong>meta\u2011FoI<\/strong> for SEPA\u2019s correspondence with the <strong>MoD<\/strong> about his requests. Emails, he says, showed a pattern of the ministry urging SEPA to <strong>withhold or delay<\/strong> on national\u2011security grounds &#8211; with added eleventh\u2011hour references to \u201cadditional considerations\u201d and requests for extra time.<\/p>\n<p>SEPA initially withheld large portions and only disclosed them after the SIC\u2019s decision. The commissioner had already examined the material and concluded publication would not harm security.<\/p>\n<div><hr \/><\/div>\n<div><hr \/><\/div>\n<h2 class=\"header-anchor-post\">The late-night data drop<\/h2>\n<p>In place of cardboard boxes, two <strong>emails<\/strong> arrived late one night \u2014 one <strong>pre\u20112019<\/strong>, one <strong>post\u20112019<\/strong> \u2014 with <strong>33 PDFs<\/strong>, ranging from single\u2011page notes to documents running over many pages. Because SEPA posts releases to its <strong>disclosure log<\/strong>, there\u2019s a risk others will spot the same trove; Edwards argues for a short <strong>grace period<\/strong> so requesters can read before being gazumped. Either way, speed matters.<\/p>\n<p>Edwards\u2019 workflow is methodical: an initial read to spot threads; a second read to test assumptions; a third to take <strong>extensive notes<\/strong>, copy key lines, build a <strong>chronology<\/strong>, and match claims to evidence. Then come the <strong>rights of reply<\/strong> \u2014 SEPA, the MoD, experts and campaigners. From the email drop to publication took about <strong>a week<\/strong>.<\/p>\n<h2 class=\"header-anchor-post\">What Edwards found<\/h2>\n<p>The papers contain few numbers, but identify <strong>tritium<\/strong> as the pollutant. Loch Long\u2019s volume means significant dilution, and Edwards is cautious about overstating risk.<\/p>\n<blockquote>\n<p><strong>Still, tritium\u2019s ~12\u2011year half\u2011life and its ability to bind with water and organic matter raise questions \u2014 and, Edwards says, \u201cno artificial radioactivity from the bombs programme should be in the environment without the public being told.\u201d<\/strong><\/p>\n<\/blockquote>\n<p>Perhaps even more concerning is the <strong>maintenance picture<\/strong>: thousands of pipes beyond design life, \u201c<strong>sub\u2011optimal<\/strong>\u201d replacement plans, and floods in sensitive areas at what he calls \u201cthe UK\u2019s most sensitive weapons site.\u201d<\/p>\n<div><hr \/><\/div>\n\n\n\n<h2 class=\"header-anchor-post\">Getting the news out<\/h2>\n<div class=\"pencraft pc-display-flex pc-alignItems-center pc-position-absolute pc-reset header-anchor-parent\">\n<div class=\"pencraft pc-display-contents pc-reset pubTheme-yiXxQA\">The story went live at <strong>noon on Saturday<\/strong> August 9 on<em>The Ferret <\/em>and <em>Guardian<\/em>\u00a0sites and led the homepage for much of the day, with a follow\u2011up in Monday\u2019s paper. Most outlets credited <strong>The Ferret<\/strong>; some did not.<\/div>\n<\/div>\n<blockquote>\n<p><strong>The Herald, for example,<a href=\"https:\/\/www.heraldscotland.com\/news\/25388110.serious-nuclear-incident-took-place-faslane-naval-base\/\" rel=\"\"> ran the story <\/a>a few days later with a line picked up from an earlier Ferret story with no mention of the Ferret &#8211; and to add insult to injury an Exclusive tab. This isn\u2019t about ego: proper credit and linking are vital to keeping this small investigative newsroom afloat. <\/strong><\/p>\n<\/blockquote>\n<div><hr \/><\/div>\n<h2 class=\"header-anchor-post\">The Ferret\u2019s model (and why credit matters)<\/h2>\n<div class=\"pencraft pc-display-flex pc-alignItems-center pc-position-absolute pc-reset header-anchor-parent\">\n<div class=\"pencraft pc-display-contents pc-reset pubTheme-yiXxQA\">The Ferret operates as a member\u2011owned <strong>co\u2011operative<\/strong> focused on Scottish accountability journalism. It relies on three revenue streams: <strong>members\/subscribers<\/strong>, <strong>grants<\/strong> for public\u2011interest investigations (with editorial independence), and <strong>co\u2011publishing fees<\/strong> from legacy outlets. In a tight subscription market, <strong>credit and links<\/strong> are not just etiquette but part of the sustainability model.<\/div>\n<\/div>\n<p>The co\u2011op recently marked its <strong>tenth anniversary<\/strong> &#8211; an impressive feat from that first kitchen table meeeting where they dined on burned pizza. They no longer let Edwards heat up the pizzas.
