This ruling effectively means any of the environmental campaigners who work with Staniford are barred from this exclusion zone.\u00a0<\/p>\n<p>The case (which will go to appeal) is internationally recognised as a SLAPP, a strategic lawsuit against public participation. That definition essentially says that the law is being unfairly used by the rich and powerful.\u00a0\u00a0<\/p>\n<p>The locations involved are far from the media\u2019s normal haunts and the case got little attention &#8211;\u00a0 \u201c<a href=\"httpss:\/\/substack.com\/redirect\/1f08b523-7fe3-4b2f-b311-fa8b7c9d4aa0?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/1f08b523-7fe3-4b2f-b311-fa8b7c9d4aa0?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw0KVcBMuzOjx7X1arJj42lo\">The Fishfarmer<\/a>\u201d probably covered it in the most detail. So what is going on?\u00a0<\/p>\n<h2>The background<\/h2>\n<p>Don Staniford, a long-time anti-fishfarm campaigner who lives in the north of England, takes a position many people would regard as extreme, because he doesn\u2019t believe a migratory species like salmon should be farmed at all. He describes farmed salmon as \u201cthe foie gras\u201d of the sea. He thinks the conditions are cruel and that leads to unacceptably high mortality &#8211; much higher than is tolerated in any form of land farming. (Staniford traveled to a fishfarm area recently with Herald journalist Vicky Allan and Allan <a href=\"httpss:\/\/substack.com\/redirect\/3c1f5880-eda0-4471-aec2-fb3b03e1e41e?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/3c1f5880-eda0-4471-aec2-fb3b03e1e41e?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw2vzblSWbcNB2wC_WJRzQmd\">calculated the average death rate <\/a>as 25% &#8211; compared to 5% for chickens.)<\/p>\n<p>Staniford regularly posts photos and videos of diseased and dying fish in fishfarm pens online, and is<a href=\"httpss:\/\/substack.com\/redirect\/927dcafe-9724-47a4-9854-fbbec8c3cbe6?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/927dcafe-9724-47a4-9854-fbbec8c3cbe6?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw0fRX9uVY5MtOc6pWTPL0UP\"> accused by MOWI<\/a> of painting a distorted picture, by editing together images in a way that makes the pens look worse than they are.\u00a0<\/p>\n<p>MOWI used to be known as \u2018Marine Harvest\u201d. It is the largest fishfarm group in the world, producing<a href=\"httpss:\/\/substack.com\/redirect\/cffc1f75-2e2c-44d2-96a8-6dadb6799161?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/cffc1f75-2e2c-44d2-96a8-6dadb6799161?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw0zIBTNMZWEVOGmyKFVe7Z4\"> 70,000 tonnes of salmon<\/a> from Scottish waters alone. Owner, multi-billionaire John Fredrikson, initially made his money from tankers and was <a href=\"httpss:\/\/substack.com\/redirect\/4f671fb7-7414-400e-869e-bdf9b8d00a86?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/4f671fb7-7414-400e-869e-bdf9b8d00a86?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw2qFCxk0x4MOuKjUymiDBve\">taken to court<\/a> by Norwegian authorities for endangering the lives of his employees by ignoring safety rules. Once the richest man in Norway, he is now a naturalised Cypriot, although he lives in a mansion in Chelsea.<\/p>\n<h2>What did Staniford do?<\/h2>\n<p>A salmon farm is a row of nets with circular hoops at the top, containing the fish. There is usually a fixed platform nearby where the workers are based &#8211; but fishfarm operation is increasingly mechanised, so much of the time there is nobody there.\u00a0<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/sceptical.scot\/staging\/wp-content\/uploads\/2023\/10\/torridon.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-15628\" src=\"https:\/\/sceptical.scot\/staging\/wp-content\/uploads\/2023\/10\/torridon.jpeg\" alt=\"\" width=\"600\" height=\"800\" srcset=\"https:\/\/sceptical.scot\/staging\/wp-content\/uploads\/2023\/10\/torridon.jpeg 600w, https:\/\/sceptical.scot\/staging\/wp-content\/uploads\/2023\/10\/torridon-225x300.jpeg 225w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>In 2019, Scottish Sea Farms, who supply Marks and Spencer, called police to move on Don Staniford, who was in a yacht near their farm. There was no suggestion at the time that he was doing anything other than photographing the fish. Staniford responded by <a href=\"httpss:\/\/substack.com\/redirect\/96f56849-1cd5-4dba-9d4a-afa826a54c88?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/96f56849-1cd5-4dba-9d4a-afa826a54c88?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw3XGUz51q3bl2Ak_JrF_wE5\">accusing Police Scotland <\/a>of acting as security guards for a private company. In 2020, a similar thing happened and Staniford filed a formal complaint, saying that he had a right to film the conditions at the farms from the open sea.<\/p>\n<p>Police Scotland later <a href=\"httpss:\/\/substack.com\/redirect\/4b5ba1e9-7a49-4b23-b5a5-81596df496b2?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/4b5ba1e9-7a49-4b23-b5a5-81596df496b2?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw3aRUuQP8OHznHVdOh6YWev\">apologised to <\/a>Staniford, saying that there would be \u2018learnings\u2019 from the incidents.\u00a0<\/p>\n<p>In 2021, Staniford <a href=\"httpss:\/\/substack.com\/redirect\/01a47b5c-855a-4475-b974-bc81ce5c41b7?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/01a47b5c-855a-4475-b974-bc81ce5c41b7?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw2xIzhE1D43pYSAqrBx6cbs\">filmed lice-infected salmon<\/a> at four MOWI farms and made an official complaint to Police Scotland\u2019s wildlife crimes unit. MOWI claimed the filming had distressed the fish and was selective, and they also made an official police complaint.<\/p>\n<p>In October that year, MOWI\u2019s lawyers served an interdict on Staniford, which <a href=\"httpss:\/\/substack.com\/redirect\/6e38af2e-a8cc-4631-94f0-9febadfc3c2b?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/6e38af2e-a8cc-4631-94f0-9febadfc3c2b?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw3SgFqSxKP0_AK7Uv_TlRHE\">asked the courts <\/a>for a permanent interdict to prevent Staniford or associates from going within 15 metres of the cages. That was put in place as a temporary measure and finally granted as permanent by a court in Oban last week &#8211; though Staniford says he will appeal.<\/p>\n<p>A legal expert who is familiar with the case but did not want to be named said:<\/p>\n<blockquote>\n<p>\u201cI have been aware for some time that this case was pending. I am extremely concerned about its implications for campaigning generally, as well as against the salmon farming industry. The water is an area where the public should pass freely. MOWI has argued successfully in the first instance that it\u2019s harassment\/dangerous to fish or people for the activist to be allowed within 15 metres of the cages. This effectively means no one can scrutinise the activities of these farms which are basically self-monitored as it is. It\u2019s a very, very dangerous ruling.\u201d<\/p>\n<\/blockquote>\n<h2>What is MOWI\u2019s case?<\/h2>\n<blockquote>\n<p><a href=\"httpss:\/\/substack.com\/redirect\/1f08b523-7fe3-4b2f-b311-fa8b7c9d4aa0?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/1f08b523-7fe3-4b2f-b311-fa8b7c9d4aa0?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw0KVcBMuzOjx7X1arJj42lo\">The Fishfarmer <\/a>quoted Mowi Scotland COO Ben Hadfield: \u201cWhile our company will listen to and engage with people who may be critical of our business, we will not stand by and accept individuals harassing and intimidating our employees at their workplace. We had sought this interdict to protect the safety and wellbeing of our employees, our fish, Mr Staniford and his associates, and we are pleased that the court has agreed with Mowi\u2019s position.\u201d\u00a0<\/p>\n<\/blockquote>\n<p>The publication reported that Scottish Sea Farms is now planning to seek a similar interdict.<\/p>\n<h2>What is a SLAPP<\/h2>\n<p>The definition of a SLAPP includes:<\/p>\n<div>\n<p>\u201cThreatening or taking abusive legal action on fully or partially unfounded claims and exploiting imbalances in financial, political or societal power while doing so.\u201d\u00a0<\/p>\n<\/div>\n<p>In a draft submission to the Council of Europe, the UK Anti-SLAPP coalition <a href=\"httpss:\/\/substack.com\/redirect\/87a7818a-20a5-44e2-bff3-f6e20c59fe69?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/87a7818a-20a5-44e2-bff3-f6e20c59fe69?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw1WMPCiEFOc_2XLVXa59aXs\">wrote<\/a>:<\/p>\n<blockquote>\n<p>\u201cIn Scotland there is currently a case, which the Coalition Against SLAPPs in Europe (CASE) <strong>has identified as a SLAPP<\/strong>, where MOWI, a salmon farming multinational company, has attempted to prevent Don Staniford, an environmental campaigner who documents and reports on the welfare and conditions of farmed salmon, from accessing the farms. After requesting that Staniford take down videos, graphics and blogs he\u2019d created about the company\u2019s salmon fish farms, while threatening legal action, in October 2021, MOWI sought permission for an interdict (injunction) against Staniford, preventing him from going within 15 metres of MOWI\u2019s fish farms, as well as other prohibitions such as not being able to fly drones within 50 metres of any farm, recording or speaking to employees or encouraging others to act on his behalf.\u201d<\/p>\n<\/blockquote>\n<p>The draft goes on to explain that SLAPPS in Scotland can have very serious consequences.\u00a0<\/p>\n<blockquote>\n<p>\u201cWhile this will generally mean a civil lawsuit, in some jurisdictions it is possible to trigger misdemeanours, administrative measures or criminal charges against their critics, including through the use of injunctions.\u201d\u00a0<\/p>\n<\/blockquote>\n<h2>Conclusion<\/h2>\n<p>MOWI accuses Don Staniford of editing photos and video in such a way as to misrepresent the condition of the fish. If that is the case, surely the best remedy might be to put webcams up so that anyone who wishes to can view the pens in real time and see how healthy the salmon are? Creating a legal exclusion zone may give the impression there is something to hide.\u00a0<\/p>\n<p>There are many other reasons to be concerned about the expansion of the salmon farming industry. I <a href=\"httpss:\/\/substack.com\/redirect\/5e8fe9c2-f40d-4ff8-bd43-a77cec1d87ac?j=eyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"httpss:\/\/www.google.com\/url?q=httpss:\/\/substack.com\/redirect\/5e8fe9c2-f40d-4ff8-bd43-a77cec1d87ac?j%3DeyJ1IjoibHdwdGcifQ.Bq0ei3VkBf6r2TFZrU1pTulkf702SO8YBQz6M46J50M&amp;source=gmail&amp;ust=1698671159919000&amp;usg=AOvVaw0czJzEJN8FoGPcc_T8WSQm\">wrote last week<\/a> how the clouds of nutrients, faeces, fish food and other detritus they spread across Scotland\u2019s sea lochs are deforming the marine ecosystem, and may threaten the spawning grounds of many other species of fish.
